The Fit Factory Privacy Policy (KRM-Z Inc)

Who we are: KRM-Z Inc d/b/a The Fit Factory (“we,” “us,” “our”), located at 620 Johnson Ave, Unit 4, Bohemia, NY 11716.

1) Scope

This policy explains how we collect, use, share, and protect information when you visit our website, join classes, buy tickets, RSVP, sign up for email/SMS, or interact with us online or at events in New York.

2) What we collect

  • Contact & account info: name, email, phone number, mailing address, emergency contact.

  • Transaction data: bookings, purchases, membership details (payment processing handled by PCI-compliant processors; we do not store full card numbers).

  • Communications: emails, texts, DMs, forms.

  • Device & usage data: cookies, IP, pages viewed, approximate location, analytics.

  • Event media (optional/with notice): photos/video from showcases or events you attend/perform in.

  • Sensitive data: We do not seek Social Security numbers or government IDs online. We do not collect biometric identifiers on the website. If that ever changes (e.g., venue access), we will post signage and never sell biometric data, per NYC law. 

Note: Under New York’s SHIELD Act, certain elements (e.g., SSN, driver’s license, financial account + access data, credentials) are “private information.” Email/phone alone are not “private information,” but we protect all personal data and apply strong safeguards. 

3) How we use information

  • Provide classes, workshops, showcases, ticketing, and customer support.

  • Send transactional notices (class confirmations, receipts, schedule changes).

  • Marketing (email/SMS) with your consent; you can opt out anytime.

  • Safety, security, fraud prevention; legal compliance; business analytics and improvement.

4) Email marketing (CAN-SPAM)

  • Every marketing email includes our postal address and an unsubscribe link.

  • We honor opt-out requests within 10 business days and do not send to opted-out addresses. 

5) SMS/Text terms (TCPA + NY telemarketing rules)

By providing your mobile number and opting in (e.g., checking a box or texting a keyword), you agree to receive recurring automated promotional and personalized marketing texts from The Fit Factory at the number used to sign up. Consent is not a condition of purchase. Message & data rates may apply. Message frequency varies. Reply STOP to cancel; HELP for help. We maintain records of consent, respect the National/State Do-Not-Call lists, and do not call/text outside 8:00 a.m.–9:00 p.m. local time. We use prerecorded/automated messages only with express written consent. 

6) Cookies & analytics

We use cookies and similar technologies for site functionality and analytics. You can control cookies in your browser; some features may not work without them.

7) Sharing information

We share data with:

  • Service providers/processors (e.g., booking, payments, email/SMS platforms, analytics) under contracts requiring appropriate safeguards.

  • Event partners only when necessary for a specific event you’ve joined (e.g., will-call list), and only the minimum needed.

  • Legal/safety purposes (e.g., responding to lawful requests or protecting rights).

We do not sell personal information.

8) Data retention

We keep personal information only as long as necessary for the purposes above—typically:

  • Account & contact info: while active + a reasonable period (e.g., 3 years) after last interaction for records/compliance.

  • Transaction records: as required by tax/accounting laws.

    When no longer needed, we securely delete or de-identify data.

9) Security (SHIELD Act compliance)

We maintain reasonable administrative, technical, and physical safeguards appropriate to our size and activities, including: appointing a security lead; risk assessments; employee training; access controls; encryption in transit; secure disposal; vendor due diligence and contracts; and periodic program updates. 

10) Incident & breach notification (New York)

If “private information” is accessed or acquired by an unauthorized party, we will notify affected New York residents and the NY Attorney General, NY State Police, and Department of State Division of Consumer Protection as required by GBL §899-aa and State Technology Law §208. 

11) Children’s privacy

Our site is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn we have, we will delete it and take steps required by COPPA. 

12) Your choices & rights

  • Email: use the unsubscribe link in any message.

  • SMS: reply STOP to any text.

  • Access/Correction/Deletion: email us to request access, corrections, or deletion of your personal information; we’ll honor reasonable requests unless we must keep data for legal obligations.

  • Do Not Track: We do not respond to browser DNT signals.

13) Third-party links

Our site may link to third-party websites or services we don’t control. Their privacy practices govern their sites.

14) International visitors

If you access the site from outside the U.S., you understand your data may be processed in the U.S., where laws may differ.

15) Changes to this policy

We may update this policy. We’ll post the new version with a new “Effective date.”
